These Terms of Service (“Terms”) are a binding agreement between you and Moneta, Inc. (“Moneta,” “we,” “us,” or “our”) governing your access to and use of the Monetawebsite and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
The Service is for teachers and other adults aged 18 or older. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date.
2. Description of the Service
Moneta lets teachers run a simulated classroom economy: define a class currency, pay students, run a rewards store, and manage balances, loans, transfers, and contracts. The currency has no monetary value and is not redeemable for real money.
3. Subscriptions and billing
- The free tier supports up to 20 students per class bank.
- Moneta Pro is $9.99/month per class bank and unlocks additional students and features. Payments are processed by Stripe.
- Subscriptions renew automatically until cancelled. You can cancel anytime; access continues through the end of the current billing period.
- Except where required by law, payments are non-refundable. Prices may change with notice.
4. Intellectual property
The Service, including its software, design, logos, and content we provide, is owned by Moneta, Inc. and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended educational purpose. You may not copy, modify, reverse engineer, or create derivative works except as permitted by law.
5. Your content and license to us
You retain ownership of the content you submit to the Service, including class settings, student rosters, rewards, and notes (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process Your Content solely to operate, secure, and improve the Service and to provide it to you. You represent that you have the rights and permissions necessary to submit Your Content and that it does not violate any law or third-party rights.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose;
- Upload content that is illegal, infringing, harassing, or that exposes personal data you are not authorized to use;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the Service, including via malware, scraping, or excessive load;
- Represent the simulated currency as real money or use it for actual financial transactions;
- Resell, sublicense, or commercially exploit the Service without our permission.
7. Student data responsibility
You are responsible for complying with your school's policies and applicable laws when you add student information, and for obtaining any consents required. You agree to use only the minimum student information necessary to operate your classroom economy.
8. Third-party services
The Service relies on third-party providers (such as our hosting, payment, and email providers). Your use of those services may be subject to their own terms, and we are not responsible for third-party services.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, Moneta, Inc. and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold Moneta, Inc. harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends and we may delete Your Content, subject to our Privacy Policy and legal retention obligations.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware, USA for any disputes, except where prohibited by applicable law.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and update the effective date above. Your continued use of the Service after an update means you accept the revised Terms.
